Terms of Service

Welcome to LoanTrack. These Terms of Service ("Terms") govern your access to and use of the LoanTrack platform, including our website, applications, APIs, and all associated services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1 Definitions
- "Platform" refers to the LoanTrack loan management software-as-a-service (SaaS) application, including all features, tools, and interfaces.
- "Tenant" refers to the organization, company, or individual that registers an account on the Platform to manage their lending operations.
- "User" refers to any individual who accesses or uses the Platform under a Tenant account, including tenant owners, administrators, branch managers, and loan officers.
- "Customer Data" refers to all data uploaded, entered, or generated through the Platform by Tenants and Users, including borrower information, loan records, and financial transactions.
- "Subscription Plan" refers to the pricing tier selected by the Tenant, which determines the features, limits, and support level available.
2 Account Registration & Eligibility
To use the Service, you must register for an account. When registering, you agree to:
- Provide accurate, current, and complete information about yourself and your organization.
- Maintain the security and confidentiality of your login credentials.
- Notify us immediately of any unauthorized access to your account.
- Be at least 18 years of age and have the legal authority to enter into these Terms on behalf of your organization.
You are responsible for all activities that occur under your account. LoanTrack is not liable for any loss or damage arising from your failure to safeguard your account credentials.
3 Subscription Plans & Billing
LoanTrack offers various subscription plans with different features and limits. By selecting a plan, you agree to the following:
Free Trial
New accounts receive a 14-day free trial. During the trial period, you have access to all features of the selected plan. No payment information is required to start a trial.
Payment
After the trial period, continued use of the Service requires a paid subscription. Payments are billed in advance on a monthly or annual basis, depending on your selected billing cycle.
Plan Limits
Each subscription plan has defined limits on the number of users, branches, loans, and other resources. Exceeding these limits may require an upgrade to a higher-tier plan.
Cancellation
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.
4 Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Platform for any illegal lending practices or activities that violate applicable financial regulations.
- Upload, transmit, or store any malicious code, viruses, or harmful data.
- Attempt to gain unauthorized access to the Platform, other users' accounts, or our infrastructure.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use automated scripts, bots, or crawlers to access the Service without prior written consent.
- Resell, sublicense, or redistribute the Service to third parties without authorization.
5 Data Ownership & Tenant Isolation
Your data belongs to you. LoanTrack operates as a multi-tenant platform with strict data isolation:
- Ownership: You retain full ownership of all Customer Data entered into the Platform. LoanTrack does not claim any intellectual property rights over your data.
- Isolation: Each tenant's data is logically separated. No tenant can access, view, or modify another tenant's data.
- Export: You may export your data at any time in standard formats. Upon account termination, you will have 30 days to export your data before it is permanently deleted.
- License: By using the Service, you grant LoanTrack a limited license to process your data solely for the purpose of providing and improving the Service.
6 Service Availability & Support
We strive to maintain 99.9% uptime for the Service. However, we cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible).
- Emergency security patches or critical updates.
- Force majeure events, including natural disasters, internet outages, or third-party service failures.
Support is provided based on your subscription plan tier. Response times and support channels vary by plan.
7 Intellectual Property
The Service, including its design, features, code, documentation, branding, and all related intellectual property, is and remains the exclusive property of LoanTrack. These Terms do not grant you any rights to use our trademarks, logos, or brand assets without prior written permission.
Any feedback, suggestions, or ideas you provide about the Service may be used by LoanTrack without obligation or compensation.
8 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LoanTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to LoanTrack in the twelve (12) months preceding the claim.
LoanTrack is a technology platform and does not provide financial advice. You are solely responsible for ensuring your lending operations comply with all applicable laws and regulations in your jurisdiction.
9 Termination
Either party may terminate this agreement:
- By You: You may cancel your account at any time through the Platform settings or by contacting our support team.
- By LoanTrack: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees after reasonable notice.
Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days to allow export, after which it will be permanently deleted.
10 Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising from these Terms shall be resolved through:
- Negotiation: The parties shall first attempt to resolve disputes amicably through good-faith negotiation.
- Mediation: If negotiation fails, the dispute shall be submitted to mediation.
- Arbitration: If mediation is unsuccessful, the dispute shall be settled by binding arbitration in Lusaka, Zambia.
11 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the Platform at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must discontinue use of the Service.
